for UNICEF UK's websites

Please read these terms and conditions (“Terms”) carefully before using this or any other UNICEF UK website. If you are under 18 and do not understand any aspect of the Terms after reading them, we kindly ask that you discuss them with a parent or guardian.

If you use any of our websites, such use will constitute your acceptance of these Terms. If you do not accept these Terms (note in particular terms 7 and 8) please do not use our websites.

These Terms apply to the entire content of our websites. Our privacy statement also forms part of these Terms and should be read and considered by you in addition to the information on this webpage. Some parts of our websites may contain additional rules which apply in addition to these Terms.

General provisions – these apply when you visit or use one of our websites:

1. Changes- we may change these Terms at any time, in which case the amended Terms will be posted on our websites and will apply from the date we post them. Please check these Terms on each occasion that you use our websites. If you continue to use our websites, you will be bound by the latest Terms.
2. Using our websites- you agree to only use our websites in a way that is consistent with all applicable laws and regulations, as well as these Terms, and does not interfere with the rights of anyone else, nor restrict or inhibit their use and enjoyment of our websites. We reserve the right in our sole discretion, and without prior notice, to deny any user access to any of our websites.
3. Privacy statement- we use, store and process information about you in accordance with our Privacy statement. By using our websites, you consent to such use, storage and processing.
4. Website content and user-added content-
   1. If you have a complaint about any content on any of our websites please notify us immediately by contacting our Supporter Care team. You can find information in our complaints procedure.When contacting our Supporter Care team to register a complaint, please be prepared to provide the following information: 
      1. Your name, company or organisation name, if relevant, and your contact details (address, telephone number and email);
      2. Details of the content that is the subject of your complaint, and why you are complaining about that content; and
      3. Confirmation from you that the information you have provided is accurate, complete and not misleading. Please note that no action can be taken without this confirmation.
   2. To the extent any of our websites allow users to post or otherwise transmit content, you must not post or transmit any material to our websites:-
      1. That is knowingly false or misleading, defamatory, illegal, abusive, vulgar, hateful, harassing, liable to incite racial hatred, blasphemous, discriminatory, pornographic, sexually oriented, threatening or invasive of a person’s privacy;
      2. Which you do not own or for which you have not obtained all necessary licences and/or approvals;
      3. Which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data); or
      4. That impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with anyone or any entity.
   3. If you post or transmit to any of our websites any material of the type prohibited under paragraph 4(b) above and we incur any costs, expenses, liability or losses as a result, then you agree to indemnify us for all such costs, expenses, liability or losses.
   4. If you post or transmit any material to any of our websites, including (without limitation) any data, questions, comments, suggestions:-
      1. Such material will be treated as nonconfidential information, and you grant us the right to use, reproduce, modify and publish such material elsewhere in our websites and publications;
      2. You grant us the right to use the name that you submit in connection with such content;
      3. We shall be entitled to reveal your identity (or any information which we have about you) to any third party who is claiming that any of that material violates any of their rights, or to any government or regulatory authority that is entitled to require us to do so; and
      4. To the extent we reasonably believe that the posting or transmission of such material constitutes a criminal offence, we are entitled to report the incident to the police or other relevant authorities.
   5. We may remove or edit any material or posting you make on any of our websites at any time.
5. Intellectual Property Rights-
   1. The UNICEF name and logo are protected under the Paris Convention. Other logos, names and images used on our websites may be trademarks of UNICEF or their respective owners, including third parties and their respective products and services. No permission is given by us in respect of the use of any such trademarks, names or logos and such use may constitute an infringement of the holder’s rights, and none of them may be copied, reproduced, licensed or otherwise exploited otherwise than in compliance with these Terms. All photographs, footage, designs, images, text, software, data and other material on our websites, or generated by our websites, are owned by us or our licensors. You are permitted to use the websites and this material only as expressly authorised by us.
   2. You are permitted to print and download extracts from our websites for your personal non-commercial use and for private study or teaching purposes, provided in each case that:-
      1. Copyright and source indications are also printed and copied;
      2. No modifications are made to the materials, and they are not used as part of any publication;
      3. Any document is printed and copied entirely and is not used in a derogatory or misleading context; and
      4. The material is not used in a manner which may damage our reputation or otherwise be harmful to us or impair our ability to achieve our charitable objects.
   3. No other use of material on our websites may be made without first obtaining our prior written permission, including in relation to the following:-
      1. Incorporating any material from our sites in any other work or publication, whether in hard copy or electronic form; or
      2. Making any commercial use or publication of any material on our websites (other than as necessary for the purpose of viewing the websites in the course of business).
   4. If you are considering using any material from our websites in a manner that is not consistent with this paragraph 5, please promptly contact our Supporter Care team to discuss the matter further, and in any case contact the Supporter Care team prior to using any materials. Failing to do so may result in action being taken against you. For any individuals wishing to raise money for UNICEF UK, please refer to the ‘Support us’ option on the website, and follow it through to ‘Fundraise’ for materials suitable for public fundraising.
   5. Any rights not expressly granted in these Terms are reserved.
6. Disclaimers-
   1. The information provided on our websites is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation, and shall not be relied on as advice. While we endeavour to ensure that the information on our websites is correct, we do not warrant the accuracy and completeness of that information. The material on our websites may be out of date, and we make no commitment to update such material. We may make changes to the material on our websites at any time without notice.
   2. You may not access our websites from countries where their contents are illegal or unlawful. If you do access our sites from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
   3. Your personal information is important to us and we take all reasonable care to ensure that donations and other transactions are conducted via our websites through a secure link. However, the security of information and payments transmitted via the internet cannot be guaranteed absolutely, and because we are not responsible for secure link operations we will not, unless we are negligent, be liable for any loss that you may suffer if a third party obtains unauthorised access to any information that you provide via our websites.
   4. We do not warrant that the functions contained in our websites will be uninterrupted or error free, that defects will be corrected, or that our websites or the servers that make them available are free of viruses or bugs or represent full functionality, accuracy or reliability of the materials. We will not be liable for any loss, disruption or damage to your data, your computer system or any other damages (including, amongst other losses, loss of profit or loss of use) arising out of your use or delay or inability to use our websites, their content or any link to another website arising in contract, tort (including negligence) or otherwise except in the case of death or personal injury caused by our negligence.
7. Liability-
   1. In creating, producing, maintaining or delivering our websites, we will not be liable for any direct or indirect loss or damage that may result to you or a third party in connection with your use, inability to use, or the results of use of our websites (including the downloading of any material from our websites), or any websites linked to our websites, including with respect to the following:-
      1. Loss or damage that was not reasonably foreseeable when you commenced using any of our websites;
      2. Any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from, or connected in any way to, business interruption; or
      3. Any amount or kind of loss or damage including, without limitation, any loss or damage due to viruses that may infect your computer equipment, software, data, or other property.
   2. Whilst we encourage our supporters to campaign on the issues referred to on our websites, please do not imply, if you choose to take action, that you are taking action on behalf of UNICEF or UNICEF UK and, in particular, do not state that UNICEF or UNICEF UK is taking, or proposes, or is considering taking, action against specific individuals or organisations, for example, the boycott of a company’s products.
8. Links-
   1. Our websites may contain links to websites that are not our own. We are not responsible for the content of websites that are not our own, and links to such websites are provided for your convenience only. The fact that we include such links does not imply that we endorse or approve of the material on those websites, or any association with their operators, and we do not accept any liability for any statements, information, products or services that are published on or are accessible through any websites that are not our own. If you decide to access any of the third-party websites linked to or from our websites, you do so entirely at your own risk.
   2. If you wish to link from your website to any pages of our websites, you may do so only on the basis that you link to, but do not replicate, the website page, and subject to the following conditions:-
      1. The linking text must simply consist of the website address;
      2. You do not remove, distort or otherwise alter the size or appearance of any logos on our websites;
      3. You do not in any way imply that we are endorsing any products or services;
      4. You do not misrepresent your relationship with us nor present any other false information about us;
      5. You do not otherwise use any UNICEF trademarks displayed on our sites without our express written permission;
      6. You do not link from a website that is not owned by you; and
      7. Your website does not contain content that is distasteful, pornographic, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.
   3. At any time and at our complete discretion we reserve the right to withdraw the permission to make website links to our websites.

10.  Partial invalidity- If any provisions of these Terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any country which apply to these Terms, then so far as these Terms apply within that country in which those provisions are illegal, invalid or unenforceable, those provisions shall be severed and deleted from these Terms and the remaining provisions of these Terms shall survive, remain in full force and effect and continue to be binding and enforceable.
11. Rights and remedies- If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms, subject to applicable limitation periods under law.
12. Law, courts and language- these Terms and the use of our websites are governed by, and to be interpreted in accordance with, English law. In the event of any dispute arising in relation to these Terms and the use of our websites, the English courts will have exclusive jurisdiction over the dispute. These Terms and our websites are provided in the English language only.
13. Payment-
